Rental Terms
Written to be read, not to be skipped. If any of this is unclear, ask before you book.
1. Who you are contracting with
Aircraft are rented by Onyx Aviation LLC, a Florida limited liability company operating under the registered trade name Hobbs Aviation, based in Southwest Florida.
Hobbs Aviation does not hold an air carrier or commercial operator certificate. All flights are conducted under 14 CFR Part 91 with the renter acting as pilot in command.
2. How you are billed
Flight time is billed on Hobbs meter time only — the meter runs when the engine runs. Tach time, block time, and ramp time are not used for billing.
The renter records Hobbs out and Hobbs in from their account. The invoice is the difference multiplied by the applicable hourly rate. Discrepancies are reconciled against the aircraft's recorded meter reading.
Rates are wet: fuel and oil uplifted at KPGD are included. There are no club dues, membership fees, or monthly minimums.
3. Fuel purchased away from KPGD
Fuel purchased off-field is not reimbursed. Where an off-field uplift is agreed in advance in writing, it is credited at $5.00 per gallon regardless of the price paid.
The renter is responsible for arriving with sufficient fuel reserves for the planned flight and is never obliged to depart with fuel they judge insufficient.
4. Block hours
Purchased block hours are drawn down against Hobbs time at the rate published for that block at the time of purchase, and are visible in the renter's ledger at all times.
Each block carries a validity window published at purchase. Unused hours expire at the end of that window unless extended in writing.
Block hours are non-transferable between renters and are not redeemable for cash. Hours are refunded pro rata where Hobbs Aviation is unable to provide an aircraft for the remainder of the validity window.
Block hours are never consumed by a cancellation caused by maintenance, weather, or any other operator-side reason.
5. Cancellation and no-shows
Bookings cancelled more than 24 hours before the scheduled start incur no charge.
Bookings cancelled inside 24 hours may be charged a one-hour minimum at the applicable rate, waived for weather below personal or legal minimums, illness, or any airworthiness concern.
Failure to appear without notice may be charged a two-hour minimum and may affect future booking priority.
Cancellations by Hobbs Aviation for maintenance, weather, or any other reason are never charged.
6. Renter responsibilities
The renter is pilot in command and holds final authority for the operation of the aircraft under 14 CFR 91.3.
The renter must hold a current and valid certificate, medical, and flight review, satisfy the published minimums for the specific tail number, and carry current non-owned aircraft insurance meeting the published minimums.
The renter must complete a preflight inspection, comply with all applicable regulations, record any squawk discovered, and must not operate an aircraft they believe to be unairworthy.
Return the aircraft secured, clean, and at the agreed time. Overnight or extended trips must be agreed in advance.
7. Damage, deductibles and grounding
Any grounding event caused by renter action may result in the renter being responsible for the operator policy deductible, subject to the renter's own non-owned coverage.
Any renter may ground an aircraft for an airworthiness concern at any time and will never be penalised for doing so.
8. Payment
Invoices are issued to the renter's account after each flight and are payable on receipt via the payment methods offered at checkout.
Block hour purchases are charged at the time of purchase.
9. Changes to these terms
These terms may be updated. The terms in force at the time of a booking or block purchase govern that booking or purchase. Material changes are communicated to account holders by email.
